Filing your divorce petition is only the first step. Your case can’t move forward until your spouse is formally served and proof of service is filed with the court. Here’s how service works in California, and the mistakes that cause delays.
Need divorce papers served?
Registered process server across Southern California. Discreet, documented, and bilingual. Se habla español.
You can’t serve the papers yourself
The California Courts Self-Help Guide is clear: the person who serves divorce papers must be 18 or older and not a party to the case. You can use a friend or relative, a professional process server, or in some counties the sheriff. Many people choose a professional so there’s no confrontation and no question later about whether service was done correctly.
What has to be served
- Copies of the file-stamped papers you filed, such as the Petition and Summons (except fee waiver forms)
- A blank Response form (FL-120)
- Any other blank forms your spouse needs to respond
How papers can be served
- Personal service is the usual method. The server hands the papers to your spouse. If they refuse to take them, the server can leave them nearby and say what they are.
- Service by mail with acknowledgment works only if your spouse signs and returns the Notice and Acknowledgment of Receipt (FL-117).
- Substituted service, posting, or publication may be options when your spouse can’t be found, sometimes with court permission.
Proof of service: form FL-115
After service, the server fills out and signs the Proof of Service of Summons (FL-115). You file the original with the court. The court won’t move your case forward until it’s filed.
What happens next
Your spouse has 30 days after being served to file a response. California also has a minimum six-month waiting period before a divorce can become final, which starts from the date of service, so prompt service matters.
Selling or transferring the house as part of the divorce?
Grant deeds, quitclaim deeds, and interspousal transfer deeds must be notarized. We handle those signings too, at your home or office. See real estate notary services.
